2. Eligibility

To use Soluciones Inclusivas services, you must be of legal age in your country of residence. By using our services, you declare and warrant that you have the legal capacity to enter into a binding contract.

4. Intellectual Property

All content present on the Soluciones Inclusivas website, including but not limited to texts, graphics, logos, icons, images, audio and video clips, as well as its graphic design and source codes, is the exclusive property of Soluciones Inclusivas or its licensors.

4.2 Client Property

Products developed specifically for each client, such as websites and digital files, are the property of the client once full payment for the service has been completed.

4.3 Badges, Seals, and Declarations

Badges, seals, and accessibility and security declarations are the property of Soluciones Inclusivas and are granted for use for a defined period according to the specific terms of each service.

5. Confidentiality

Soluciones Inclusivas is committed to maintaining the confidentiality of information provided by the client. However, disclosure of information required by law or court order will not be considered a breach of confidentiality.

6. Payment Terms

Soluciones Inclusivas offers flexibility in payment terms to adapt to our clients’ needs:

  1. Accepted forms of payment:
    • Bank transfer in euros or US dollars
    • Card payment through secure Stripe or PayPal links in euros or US dollars
  2. Payment structure: Clients can choose from the following options:
    • Full payment at the start of the service
    • Payment divided into two equal parts: 50% at the start and 50% at the end
    • Payment in three parts: 35% at the start, 30% at an agreed midpoint, and 35% at the end
  3. Start of services: Soluciones Inclusivas will begin providing services once a minimum of 35% of the agreed total has been received.
  4. Additional costs: The client will assume any additional costs associated with bank transfers or card transactions.
  5. Invoicing: Soluciones Inclusivas will issue detailed invoices for each payment received, which will include a breakdown of the services provided.Additional costs: The client will assume any additional costs associated with bank transfers or card transactions.

7. Service and Product Delivery

7.1 Delivery Format

All deliverables as part of our services are provided in digital electronic formats, according to the type of content. We deliver both the final version and editable files or source code, when applicable.

7.2 Delivery Method

Deliverables are sent from email addresses with our domain (example: [email protected]), according to the person coordinating the service. No delivery is made in physical format or on physical storage devices.

7.3 Scans and Analysis

As part of our services, we perform scans on websites to detect vulnerabilities, accessibility errors, and determine the technological profile. By requesting a quote or contracting a service, you accept these types of scans.

7.4 Feedback

At the end of each service, we request a feedback meeting. Although optional, we strongly recommend participating in this meeting to improve our services.

7.5 Social Impact Measurement

To evaluate our social impact, we conduct periodic reports on how our services affect organizations and the people who interact with them. We will request statistical information on how the application of our services has positively or negatively impacted your organization and its users. Responding to these requests is optional, but significantly contributes to the continuous improvement of our services and the measurement of our social impact.

8. Warranty and Liability

8.1 Quality Commitment

Soluciones Inclusivas is committed to providing high-quality services in accessibility, digital security, and optimization. We strive to stay updated with industry standards and best practices.

8.2 Warranty Limitations

While we strive to offer effective solutions, we cannot guarantee specific results or the total absence of errors. Our services are provided “as is” and “as available”.

8.3 Advisory and Support

We offer specialized advice during and after the provision of our services. In case problems arise related to our work, we commit to providing support and guidance to resolve them.

8.4 Legal Responsibility

Soluciones Inclusivas will not be responsible for indirect, incidental, special, or consequential damages resulting from the use of our services. Our liability is limited to the amount paid for the specific service in question.

9. Cancellation and Refunds

Services can be canceled before the start date agreed in the contract. After this date, cancellation or refund will not be possible, except in exceptional circumstances that will be evaluated on a case-by-case basis.

10. Modifications

Soluciones Inclusivas reserves the right to modify these Terms and Conditions at any time. Modifications will take effect immediately after their publication on our website.

11. Applicable Law and Jurisdiction

These Terms and Conditions are governed by the laws of the State of New Mexico, United States. Any dispute will be subject to the exclusive jurisdiction of the courts of New Mexico, USA.

12. Dispute Resolution

In case of conflict, the parties commit to trying to resolve the dispute with honesty and collaborative disposition. If an agreement is not reached, arbitration will be resorted to before going to court.

13. Severability

If any provision of these Terms and Conditions is deemed invalid or unenforceable, the remaining provisions will remain in full force and effect.
